TrueRep is a website, truerep.app, (“Site”) and mobile application (“App”) (collectively, “Services”) that exist to provide users with a resource to track and analyze your exercise and provide essential metrics to optimize every exercise rep. The Services are provided and moderated by Ozark Apps Development LLC (“Ozark Apps”), an Arkansas limited liability company.

About OZARK APPS and our Privacy Policy

Ozark Apps understands how important privacy is to you and we are committed to creating a safe environment for athletes.

A note about youth athletes: Ozark Apps may be used athletic programs for youth athletes (collectively referred to as “Youth Programs”). When Ozark Apps enters into a contract with Youth Programs to provide the Services as part of an athletic program, we will have limited access to personal information about youth athletes (“Youth Users”). Please see the section entitled “Youth Users” for information about what information we gather during the provision of the Ozark Apps Service to Youth Programs.

WHAT WE COLLECT & HOW WE USE IT

We respect your information and our goal is to collect as little personal information as possible while still providing a quality service to you. We receive and store information about individuals in a range of ways.

Information You Give Us. The majority of the information we collect from you is when you create an account, including your name and e-mail address.

We do collect information from accessing our Site, like when you fill out forms on our Site. The information we collect from you is used to potentially provide the Service to you and to fulfill any obligations from us or you in regards to the Service. This information includes records and copies of your correspondence with us and details of any transactions with us.

In order to use the Services, you will need to grant us permission to use your camera. Ozark Apps will not store the video and the information used to provide you with analysis does not leave your device.

Information Automatically Collected. We automatically log information about you and your computer. For example, when visiting our Site, we log IP address, date and time of access, location information, browser information, operating system information and information about your use of and actions on our Site. While you use our site, we also collect information related to how you interact with us, such as your path through our Site or how long you interact with our Site. This information allows us to update our services and learn how we can better equip the Site to serve you.

Youth Users and Student Records

When the Service is used as part of Youth programs, Ozark Apps collects personally identifiable information from or about Youth Users or other information protected by similar student data privacy laws (“Student Records”). We consider Youth Athlete Data to be strictly confidential and do not use such data for any purpose other than improving and providing our products and services to the athletic program or on the athletic program’s behalf. Our collection, use, and sharing of Youth Athlete Data is governed by our contracts with the athletic programs, and other applicable laws that relate to the collection and use of Student Records. If you are a youth athlete that has used our Service and have questions about reviewing, modifying, or deleting your Student Records, please contact your athletic program directly.

Ozark Apps uses this information in the following ways:

By providing our services, we primarily use the information we collect to provide reporting and analysis to you. This includes:

  • How you use the Services;
  • When you track and complete exercises using the Services;
  • What you look at on the Services; and
  • What activities you complete on the Services, including your weight used for the activities and the amount of repetitions.

In addition to providing this feedback, we may use the information we collect in the following ways:

To provide and enhance our Service. We use your information to operate, maintain, enhance, and provide all of the features of our Services.

To personalize your experience. We use the information to personalize your experience while using the Services. For instance, Ozark Apps remembers your recent activity so we can recommend the weight to use for your next workout and provide personalized exercises.

To communicate with you. We use your information to communicate with you about your workout and respond to inquiries.

To understand, improve, and develop our Services. Ozark Apps uses all of the information that you provide or that we collect from users to understand and analyze the usage trends and preferences of our users, to improve the way the Services work and look, and to create new features and functi onality. When we use information for these purposes, we implement appropriate safeguards,including removing your personal identifiers like your name.

Payment Information

When you make a payment on Ozark Apps, you may provide payment information such as your payment card or other payment details. We use Payment Card Industry compliant third-party payment services and we do not store your credit card information. We currently use Stripe for payment processing and you can find the privacy policy for Stripe at https://stripe.com/privacy.

SHARING OF PERSONAL INFORMATION

The goal of Ozark Apps is to provide users with a resource to track and analyze their exercise. Protection of your personal information is important to us. We do not sell or trade your personal information with others.

We do not sell or trade your personal information with others. We may share personal information as follows with GDPR-compliant third parties:

  • We may share personal information with your consent. For example, you may let us share personal information with others to provide exercise community or Services to you at your request.
  • We may share aggregate or anonymous data (data that has had personally identifying characteristics, like your name or address) with third parties for advertising purposes for our events, services, or products and as part of providing our Services.
  • We may share personal information when we do a business deal, or negotiate a business deal, involving the sale or transfer of all or a part of our business or assets. These deals can include any merger, financing, acquisition, or bankruptcy transaction or proceeding.
  • We may share personal information for legal, protection, and safety purposes.
    • We may share information to comply with laws.
    • We may share information to respond to lawful requests and legal processes.
    • We may share information to protect the rights and property Ozark Apps, our agents, customers, and others. This includes enforcing our agreements, policies, and terms of use.
    • We may share information in an emergency. This includes protecting the safety of our employees and agents, our customers, or any person.
  • We may share information with those who need it to do work for us.

INFORMATION CHOICES AND CHANGES

In some jurisdictions, you have rights to control how your personal information is used. You may have the right to request access to, change to, or erasure of personal information we hold about you. In the EU, you also may have the right to object to or restrict certain types of use of your personal information and request to receive a copy of the personal information you have provided to us.

We will keep your information for as long as you have an account or as long as we need it to fulfill the purpose for which it was collected or disclosed to you at the time of collection. We may also keep some of your information as required to meet legal or regulatory requirements, resolve disputes, prevent fraud or abuse, enforce our Terms of Use, or for other permissible purposes.

STORAGE OF INFORMATION

Your information collected through the Site is processed in the United States. If you are based in the United States and use our Site, you consent to have your information processed by Ozark Apps in the United States. International clients have differing needs based on their country of origin and we provide custom storage and processing solutions to meet those requirements.

The security of your information is important to us. We use commercially reasonable technical and organizational safeguards to protect your information from unauthorized use, disclosure, and loss.

We encourage you to take reasonable measures to protect your password and your computer to prevent unauthorized access to your account. Data transmission over the Internet, mobile networks, wireless transmission or electronic storage of information is a risk and cannot be 100% secure. As a result, we cannot guarantee or warrant the security of any information you transmit to or from our Site, and you provide us with your information at your own risk.

CHILDREN

Ozark Apps does not permit children under the age of 13 to create an account. Please contact us at brody@truerep.app if you believe we have inadvertently collected personal information from a child under 13 so that we may delete the information as soon as possible.

INFORMATION FOR VISITORS FROM EUROPE

If you live in the European Economic Area (EEA), United Kingdom (UK), or Switzerland, you have the right to access, rectify, download or erase your information, as well as the right to restrict and object to certain processing of your information. Please review these additional privacy disclosures under the European Union’s General Data Protection Regulation (“GDPR”).

Ozark Apps relies on a number of legal bases to collect, use, share, and otherwise process the information we have about you for the purposes described in this Privacy Policy, including:

  • As necessary to provide the Services and fulfill our obligations pursuant to the Terms of Service. For example, we cannot provide the Services unless we collect and use the data related to your workout;
  • Where you have consented to the processing;
  • Where necessary to comply with a legal obligation, a court order, or to exercise and defend legal claims;
  • To protect your vital interests, or those of others, such as in the case of emergencies; and
  • Where necessary for the purposes of Ozark App’s or a third party’s legitimate interests, such as our interests in protecting our commercial interests in ensuring the use of the Services.

The Services are hosted in the United States. If you are visiting the Service from outside the United States, your information may be transferred to, stored and processed in the United States in accordance with this Policy and applicable U.S. laws. Please note that data protection and other applicable laws of the United States may differ from the data protection or consumer protection laws in your country. By using the Service, you consent to transfer, storage, and processing of your information to our facilities as described in this Policy.

RETENTION OF INFORMATION

We retain information as long as it is necessary to provide the Services to you and others, subject to any legal obligations to further retain such information. Information associated with your account will generally be kept until it is no longer necessary to provide the Services or until your account is deleted. Following your deletion of your account, it may take up to 90 days to fully delete your personal information and system logs from our systems. Additionally, we may retain information to comply with the law, prevent fraud, collect fees, resolve disputes, troubleshoot problems, assist with investigations, enforce the Terms of Service and take other actions permitted by law. The information we retain will be handled in accordance with this Privacy Policy.

Information connected to you that is no longer necessary and relevant to provide our Services may be de-identified or aggregated with other non-personal data to provide insights which are commercially valuable to Ozark Apps, such as statistics of the use of the Services.

CHANGES TO THIS PRIVACY POLICY.

The Services and our business may change from time to time. As a result, at times it may be necessary for Ozark Apps to make changes to this Privacy Policy. Ozark Apps reserves the right to update or modify this Privacy Policy at any time and from time to time. We will notify you by means of a notice on this Site or App of any material changes to this Privacy Policy. Your continued use of the Services after any changes or revisions to this Privacy Policy shall indicate your agreement with the terms of such revised Privacy Policy.

INFORMATION FOR VISITORS FROM CALIFORNIA AND OUTSIDE OF THE UNITED STATES

PRIVACY RIGHTS FOR CALIFORNIA RESIDENTS

This PRIVACY NOTICE FOR CALIFORNIA RESIDENTS supplements the Privacy Policy of Ozark Apps Development LLC (“Ozark Apps”) and applies solely to visitors, users and others who reside in the State of California (“you”) when you visit the Ozark Apps TrueRep website, www.truerep.app (the “Site”) or the mobile application (the “App”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and other California privacy laws. Any terms defined in the CCPA have the same meaning when used in this notice.

Information We Collect

We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“personal information”). In particular, we have collected the following categories of personal information from consumers within the last twelve (12) months:

Personal information categories listed in the California Customer Records provisions, and payment information, such as your credit card number.

Internet or other electronic network activity information, such as session logs.

Geolocation data, such as the physical location of your recorded activity.

Inferences drawn from any of the above information to create a profile reflecting your preferences, characteristics, behavior, abilities, and aptitudes.

According to California law, personal information does not include:

Publicly available information from government records.

De-identified or aggregated consumer information.

By providing our services, we primarily use the information we collect to provide reporting and analysis to you. This includes:

  • How you use the Services;
  • When you track and complete exercises using the Services;
  • What you look at on the Services; and
  • What activities you complete on the Services, including your weight used for the activities and the amount of repetitions.

In addition to providing feedback, we may use or disclose the personal information we collect for one or more of the following business purposes:

  • To improve our Site.
  • As necessary or appropriate to protect the rights, property or safety of us, our customers or others.
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
  • As described to you when collecting your personal information or as otherwise set forth in the CCPA.
  • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us is among the assets transferred.

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

We may disclose your personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

Your Rights and Choices

California residents have the right to request that Ozark Apps disclose what personal information it collects, uses, discloses or sells. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • Our business or commercial purpose for collecting that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).

Ozark Apps does not sell your personal information to third parties. However, under some circumstances a transfer of personal information to a third party without monetary consideration may be considered a “sale” under California law. If you submit a request to stop selling your personal information, we will stop making such transfers. Deletion Request Rights

California residents also have the right to request the deletion of their personal information collected or maintained by Ozark Apps.
